    Woman not responsible for abetting suicide of lover due to ‘love failure’: Delhi HC

    While granting pre-arrest bail to two individuals in an abetment of suicide case, the Delhi High Court noted that a woman cannot be held responsible for encouraging a man to commit suicide if the man ends his life as a result of “love failure.”
    The court ruled that a man with a “weak and frail mentality” could not be held accountable for his poor decision.
    “The lady, examiner, and lawyer, respectively, cannot be held to have abetted the commission of suicide if a lover commits suicide due to love failure, if a student commits suicide due to his poor performance in the examination, or if a client commits suicide because his case is dismissed,” Justice Amit Mahajan stated.?
    The decision was made while the woman and her friend, who are accused of encouraging the man to commit suicide in 2023, were granted anticipatory bail by the court.
    The man’s father filed a complaint alleging that the woman had previously dated his son romantically and that the other accused—represented by senior advocate Maninder Singh—was a mutual friend.
    The deceased was said to have been provoked by the applicants, who told him they were having sex and would soon tie the knot. His mother discovered the deceased’s body in his room.
    The deceased had written in a suicide note that he was killing himself because of the two applicants.
    The high court acknowledged that the deceased had included the applicants’ names in his suicide note, but it felt that there was insufficient evidence to suggest that the threats were severe enough to cause a “normal person” to consider suicide.
    According to the statement, “it cannot be inferred that the applicants had any intention that led the deceased to commit suicide. Primarily, the alleged suicide note only expressed a state of anguish of the deceased towards the applicants.”
    According to the court, based on the recorded WhatsApp conversations, it seemed that the deceased had a delicate disposition and frequently threatened to kill himself.
