In the Delhi excise policy “scam” case, BRS leader K Kavitha was denied bail by the Supreme Court on Friday after she was arrested by the Enforcement Directorate on March 15.
Kavitha was asked to approach the trial court by a bench of Justices Sanjiv Khanna, MM Sundresh, and Bela M Trivedi. They explained that this court is following protocol and cannot circumvent it.
Regarding Kavitha’s argument contesting the terms of the Prevention of Money Laundering Act (PMLA), the Bench stated that the ED will be notified by the court and asked to respond within six weeks.
Senior advocate Kapil Sibal, who was representing Kavitha, was informed by the bench that “the petition challenging the provisions will come up with the pending matters.”
Sibal stated right away that an approver’s statement is the basis for arrests.
The Bench declared that it would not discuss the case’s merits at this time.
Kavitha has filed a petition with the top court contesting her arrest by the ED in relation to the Delhi excise policy case.
Kavitha is an MLA in the Telangana Legislative Council and daughter of former state chief minister K Chandrashekar Rao. She was arrested on March 15 and remanded to the ED’s custody till March 23 in the case.
