Delhi High Court Orders Unique Sentence Following Settlement in Modesty Case

In a peculiar turn of events, the Delhi High Court has quashed an FIR (First Information Report) filed against a man accused of outraging the modesty of a woman. This decision came following an amicable settlement between the parties involved. However, what sets this case apart is the unconventional order issued by Justice Navin Chawla.

The accused, whose charges under Sections 354, 506, and 509 of the Indian Penal Code were dismissed, has been directed by the court to assist the Traffic Police at a designated traffic signal for a duration of 30 days. Justice Chawla emphasized that failure to comply with this order will lead to further legal action.

The ruling was based on the acknowledgment that the complainant woman, present in the court through video conferencing, voluntarily opted for settlement without any coercion. Justice Chawla highlighted the futility of continuing with the proceedings, considering the desire of the complainant to not pursue the case further and the agreed settlement between the parties.

As part of the court’s directive, the accused is obligated to report to the Traffic Police authority and fulfill his duties at the designated traffic signal. Justice Chawla emphasized the importance of compliance by stating that at the end of the 30-day period, the DCP Traffic must issue a certificate to the petitioner. Failure to submit this certificate within two months will prompt further court intervention.
